原文 "The validity of a norm cannot be derived from the fact of its existence, but only from another norm." Sein(存在)と Sollen(当為)の方法的峻別というカント的・新カント派的方法論を法理論の出発点に据える定式。事実が反復されるからといって規範になるのではなく、規範の妥当は別の規範に支えられている。この支え合いの連鎖が規範のヒエラルキー (Stufenbau) を形作り、その頂点に仮説的な根本規範 (Grundnorm) が置かれる。
